Terms of Sale Process
due May 12, 2023
- Minimum Initial Bid is 10.50% (expressed as % of BTC spot price)
- Initial Bids are non-binding and subject to diligence and documentation
- Bidders may be asked to produce proof of ability to close
due May 17, 2023
- Prior to submitting a bid, bidders may request additional diligence, including a meeting with the creditor via video conference
- Bids must include the best and final purchase price (expressed as a percentage of the spot price of BTC), and any material terms of the trade that deviate from the Seller’s preferred sale terms and the precedent trade documentation included in the Data Room
- Any commission due to Xclaim is the sole responsibility of Seller. Buyer shall have no payment obligations other than the purchase price.
- All Registered Buyers of the Xclaim Market and any other bidder that agrees to the Claim Sale Process Agreement available in the Data Room
